  2. When you browse through our website, use our services, create an account, share contents or, more generally, run our apps, we collect information and data about you. For such reason, and in accordance with the Privacy Code for the Protection of Personal Data (Legislative Decree June 30th, 2003 n. 196 consolidated text or "Privacy Code"), we have created this Privacy Policy in order to specify to you which personal data is collected, the purposes and conditions for the processing of your personal data as well as the security measures implemented to protect such data

    More specifically, this Privacy Policy represents the privacy statement issued, pursuant to article 13 of the Privacy Code, drafted in accordance with Recommendation n. 2/2001, adopted by the Data Protection Working Party on May 17th, 2001 - article 29 in relation to the minimum requirements for the on-line collection of data in the European Union. Moreover, we here by inform you that this Privacy Policy only applies to the website, to its services and to the apps “MYagonism basket stats” and “Coach Agenda” (hereinafter referred to as the "Services") and shall not apply to third party web sites which may be accessed through links or banners.

  3. Source of data and purposes of the data processing

The computer systems used to operate the Services acquire, during the normal course of operation, some of your personal data whose transmission is implicit in the communication protocols of the internet. Such data in not collected with the aim to identity you, but could lead to your identification if, by way of example, combined with data held from third parties. This category of data includes IP addresses and domain name of your computer, URI addresses (Uniform Resource Identifier) of requested resources, the time of request, the method utilized to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server and other parameters related to your operating system. Such data is used only to obtain anonymous statistical information on the use of the Services and to check its correct functioning and is deleted immediately after its processing. Such data could be used to ascertain responsibility in case of hypothetical computer crimes against the Services.

    3. Registration data and additional data
    4. Browsing through our website does not require the creation of a personal account. Nevertheless, in order to access the areas reserved to registered users and benefit from our Services, you will need to create a personal account and therefore become a registered user. At the time of the creation of the account, if you register yourself under the category "professional sportsman" we shall ask you to enter the following Registration Data: email address, name, surname, gender, date of birth. Once your account has been created, you will be able to complete your profile by entering Additional Data such as your town of birth and a profile picture.

      If you register yourself under the category "club", we shall ask you the following Registration Data: email address, name and surname of the contact person, name and date of the club's foundation. In order to enrich the "club's" profile you can insert the town and club logo.

      In order to use our Services it is necessary to provide us with your Registration Data. Any refusal to provide such data will limit your browsing on our website to areas not reserved to the registered users and will prevent you from using of our app.

      Providing us with Additional Data is instead optional. Any refusal to provide such data would still allow you the use our Services although you won't be able to make use of its full potential. By way of example, by customizing your profile with Additional Data, you will have the opportunity to show other registered users your game level and you will be able to compare your number of baskets and game plan with the one of different users.

      In the event you have to collect and process data referred to third parties, you shall comply with the provision set forth in the Privacy Code (by way of example, if requested, you shall comply with the informative and consent requirements).

    5. Further Purposes.
    6. With your consent, we shall use the information provided by you for further purposes. These shall include market research, profiling and sending by email of promotional material related to products, services, initiatives and events offered by MYagonism or by its business partners. In this way, we shall be able to customize our Services on the basis of your profile, show you contents in line with your interests and develop services closer to your needs.

      Providing information for such purposes is optional. Any refusal to provide such information would still allow you to use our Services although it would prevent us from pursuing the abovementioned purposes, limiting the content customization offered to you. In any case you can always revoke your consent for the collection and processing of personal data related to you, also for profiling and marketing purposes, by modifying your account settings, by closing your account or by sending an email to the following address:

    7. Data collected through cookies and other technologies
    8. Cookies are small text files sent to the user's device by the visited website. Cookies are stored in the device's memory used to access the site (e.g. computer, smartphone, tablet and any other device used to access the sites). When users access a site once again, the browser will read the cookies memorized on the device and transmit the data to the site that originally created the cookie.

      Also MYagonism uses various types of cookies. More specifically, while some cookies are managed directly by us, the management of other cookies is carried out by third parties and MYagonism has no control whatsoever over them. Some cookies are necessary for the purpose of using the Services, others have instead different purposes such as to provide you with advertising based on your interests or perform statistical analysis.       MYagonism also uses technologies similar to cookies such as, by way of example, pixel tags. As stated also in the banner you have seen the first time you accessed the site, such technology allows us to perform statistical analysis, detect your preferences and provide you a service in line with your interests. Unlike cookies, the management of such technologies for the Service user is more complex and, for this reason, if you want to object to the use of such profiling tools, we encourage you to send an email to the following address:

    10. Our goal is to provide you with the best possible service and it is for this reason that our Services are constantly evolving. In the future we may offer you new services for which we may ask you to provide additional data and consent for their processing. In such case we shall amend the Privacy Policy in accordance with the new requirements for data collection and shall inform you of the changes by means of a notice published on the homepage of our website. In any case, we encourage you to periodically verify the Privacy Policy in order to acknowledge possible amendments to it.

  4. Data processing conditions and data retention.

We process your data with and without electronic means and in accordance with security measures provided by applicable law, with particular but not exclusive reference to Annex B (Technical Regulations regarding minimum security) of the Privacy Code. Our security measures include contractual tools with any contracting party (e.g. service provider) or agent in order to ensure the safeguarding and confidentiality of your personal data in accordance with the Privacy Code.

    4. We store your personal data until your account is active. If your account is inactive, we shall store the date if this is necessary to meet the obligations imposed by law or regulation, to safeguard our rights, to prevent frauds or to enforce this Privacy Policy.

  5. Scope of the communication.
    1. Public and private profile, search engines indexing and social network.
    2. Certain data provided in your account will always be accessible to Service users and such setting cannot be modified. Such data includes your name and surname.

      You may also decide whether to share your data with all other Service users or only with your closest connections. Your data will not be indexed by search engines.

      Furthermore, you can connect your MYagonism account to your favorite social network account, such as, by way of example, Facebook, Twitter, Linkedin. This will allow you to share your MYagonism account data also on these services. For example, you will be able to post on the Facebook the number of baskets made during a game or the outcome of a game. By connecting the MYagonism account to the one of a different social network, you will allow the social network to access, store and communicate such data. We remind you that MYagonism and other social networks available on the internet are managed by different companies. Therefore, once you share on the social networks the data provided by MYagonism, we will not be able to control the uses that others do of such data. For this reason, we encourage you to read the conditions of use and the privacy policy of the social network with which you choose to connect your MYagonism account.

    3. Internal and external communication of personal data

Your personal data will be processed only by subjects previously appointed by MYagonism or by its data processors as persons in charge of the data processing pursuant to article 30 of the Privacy Code, or by the data processor appointed by MYagonism pursuant to article 29 of the Privacy Code, if any.

      Your data may be disclosed to the following categories of external subjects: service providers (professional and technical), legitimate recipients pursuant to law and, subject to your consent as stated above, to third parties companies that carry out marketing activities and analysis.

      The data recipients act as data controllers, data processors or persons in charge of the processing in accordance with applicable law.

    5. Transfer of data abroad
    6. Your personal data may be transferred outside Italy but within the European Union. Such transfer is allowed since each of these countries ensure an adequate level of protection of personal data comparable to the one ensured by the Privacy Code. Nevertheless, MYagonism may also transfer your data to third countries, outside the European Union, which do not ensure the same level of data protection. We inform you that such transfer to third countries will be carried out in accordance with the Privacy Code, therefore MYagonism will gather your consent, if required, or adopt any other measure needed to ensure the safety of your data being transferred. Among such measures there are possible contractual arrangements based on the standard contractual clauses issued by the European Commission and set forth by article 44 of the Privacy Code.
      More specifically, we inform you that your personal data is stored on the servers of Amazon Inc. Such company ensures the security of data and therefore the legitimacy of the transfer of the same, having signed the commitments provided by the Safe Harbor US-EU program for the transfer of personal data abroad.

    7. Change of Control
    8. If we were to be involved in a reorganization, acquisition, transfer of business or of a business branch, we shall disclose your data to third parties involved in the procedure. Any third party that under this procedure is deemed to be recipient of your data, may use them within the limits set forth in this Privacy Policy.

At any time you may exercise the rights provided by article 7 of the Privacy Code and may, by way of example, access the data, verify its content, origin, accuracy of the data, as well as requesting integration, updating, rectification, cancellation or the blocking of data for violation of the law and you can object to the processing.
